1) Acceptance of these Terms
By accessing https://mothslayer.com/ (the “Site”) or purchasing our products (the “Products”), you agree to these Terms & Conditions and to our Privacy Policy and Shipping & Returns Policy (collectively, the “Agreement”). If you do not agree, do not use the Site or purchase our Products.
2) Who may use our Site
You must be at least 18 and reside in the United States to purchase. We ship to U.S. addresses only. We may decline or cancel any order at our discretion.
3) Product information; lawful use
Our Products include live biological control organisms intended for wardrobe pest management. Use only as directed and in accordance with applicable laws and guidance. You represent and warrant that your purchase, receipt, deployment, and disposal comply with all federal, state, and local requirements, including any permitting or use restrictions that may apply to biological control organisms. We may cancel orders to locations where shipment or use is restricted.

4) Ordering, pricing, and payment
- Prices are shown in U.S. dollars and are subject to change without notice.
- Taxes and shipping are calculated at checkout where applicable.
- We use a third-party payment processor; by paying, you agree to its terms. Title and risk of loss transfer according to the shipping terms below.
5) Shipping and delivery (U.S. only)
- We ship to U.S. addresses only (no international orders).
- If a delivery date is provided, it is an estimate. If we cannot ship on time, we will notify you and offer a choice to accept the delay or receive a prompt refund.
- Risk of loss passes to you upon delivery to the shipping address you provide. Inspect shipments on receipt and report issues within 5 days.
6) Returns and refunds (30-day, hassle-free)
We offer 30-day, no-questions-asked returns from delivery. To start a return, contact returns@mothslayer.com with your order number. We will provide instructions and a refund to your original payment method once processed.
- For live biological products, we may not require a physical return for safety/compliance; in those cases we’ll issue a refund or replacement after verifying order details.
- Original shipping charges are refundable.
- Abuse of the policy (e.g., repeated claims inconsistent with ordinary use) may result in refusal of future returns.

7) Intellectual property
All content on the Site, including text, graphics, logos, icons, images, and software, is owned by Moth Slayer or its licensors and is protected by law. You may use the Site for personal, non-commercial purposes only. No license is granted except as necessary to use the Site as intended.

Do not misuse the Site. Prohibited activities include illegal activity; attempting to interfere with security or operations; scraping without consent; reverse engineering; or using the Site to advertise or solicit without our written permission.
9) User content (reviews, submissions)
If you post reviews or other content, you grant us a worldwide, royalty-free license to use, reproduce, and display that content in connection with the Site and our business. You represent you own or control necessary rights in any content you submit and that it is accurate and lawful.

We do not guarantee that a particular Product is lawful for your intended use at your location. We may request information to verify compliance and may cancel an order if compliance cannot be verified.

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free or that the Products will meet your specific goals or outcomes in every environment.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTH SLAYER AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

14) Indemnification

15) Governing law; arbitration; venue
These Terms are governed by the laws of Delaware, United States of America.
Mandatory arbitration and class-action waiver. Except for small-claims matters, any dispute arising from or relating to the Agreement will be resolved by binding arbitration administered under its Consumer Arbitration Rules. Arbitration will take place in Wilmington, Delaware or by remote appearance if allowed. You and we waive any right to a jury trial and to participate in a class or representative action. Judgment on an award may be entered in any court of competent jurisdiction.
16) Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor issues, supply shortages, carrier delays, regulatory actions, or utility interruptions.
17) Changes to the Site or Terms
We may modify the Site or these Terms at any time. Changes are effective when posted with a new Effective Date. Your continued use after changes means you accept the updated Terms.
18) Assignment
You may not assign or transfer your rights under this Agreement without our prior written consent. We may assign our rights and obligations as part of a corporate transaction or otherwise.
19) Severability; entire agreement; no waiver
If any provision is found invalid or unenforceable, the remaining provisions remain in effect. This Agreement is the entire agreement between you and us regarding the Site and Products. Our failure to enforce any provision is not a waiver.
